Please feel free to browse the Site; however, your access and use of the Site is subject to these Terms and all applicable laws.

You shall use this Site for lawful purposes only. You shall not post or transmit through this Site any information or material that violates or infringes, in any way, the rights of others, or which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, harassing or otherwise objectionable. Nor shall you post or transmit through this Site any information or material which encourages conduct that would constitute a criminal offense, give rise to liability or otherwise violate any law or administrative ruling or guidelines, is in violation of these Terms, or which, without the Company's prior written approval, contain advertising or any solicitation with respect to products or services. Any conduct by you that, in the Company's opinion, restricts or inhibits any other user from using or enjoying this Site will not be permitted.

This limited authorization is not a transfer of title in the Materials and by your use of this Site, you acknowledge that you do not acquire any license, ownership or other rights to the Materials. Modification of the Materials or use of the Materials for any other purpose is a violation of the Company's or such other sources' copyright, trademark and other proprietary rights and may violate other laws. The use of any such Materials on any other website or networked computer or environment is prohibited without the Company's express written consent. Cookies Notice

Introduction

This Notice ("Notice") applies to this website ("Website") and to any websites, branded pages on third-party platforms (such as Facebook, LinkedIn or Twitter) and applications accessed or used through such websites or third-party platforms (“the North American Coal Sites”), which are operated by or on behalf of The North American Coal Corporation, its subsidiaries and/or affiliated companies (hereinafter “North American Coal”, "we". "us", "our"). This Notice sets out how we collect and process information about you on the North American Coal Sites through the use of cookies. We use the term "cookies" in this Notice to refer to website cookies and to similar technologies that may collect information automatically when you visit the North American Coal Sites (such as pixel tags, web beacons, device IDs and similar technologies).

What is a cookie?

A cookie is a small text file or a piece of information that may be stored on your computer or mobile device when you visit a website. Almost every website uses cookie technology. Cookies serve a number of purposes such as letting you navigate between webpages efficiently, remembering your preferences, and generally improving the user experience. Cookies may tell us, for example, whether you have visited our Website before or whether you are a new visitor. They can also help to ensure that adverts you see online are more relevant to you and your interests. This functionality makes cookies extremely useful to improve your user experience when you return to a website you have already visited.

How long do cookies last for?

Cookies can remain on your computer or mobile device for different periods of time. Some cookies are 'session cookies'. These cookies exist only while your browser is open and are deleted automatically once you close your browser. Other cookies are 'persistent cookies'. These cookies survive after your browser is closed until a defined expiration date. They can be used by websites to recognize your computer when you open your browser and browse the Internet again.

What other technologies are used to track my North American Coal Site visits?

We may also use other tracking technologies, such as pixel tags and web beacons, to better tailor the North American Coal Sites in order to provide a better service. These technologies usually work in conjunction with cookies. To disable cookies used on the North American Coal Sites, and therefore any other tracking technologies that work in conjunction with these cookies, please follow the instructions below.

What types of cookies do we use?

There are two broad categories of cookies.

Cookies that are essential for the operation of the North American Coal Sites, also known as Strictly Necessary Cookies, enable features without which you would not be able to use the North American Coal Sites as intended. Your consent is not required for the use of Strictly Necessary Cookies, which is why Strictly Necessary Cookies cannot be disabled using the features of or the links on the North American Coal Sites. However, you have the option to completely disable cookies in your browser at any time. The other category of cookies is cookies which are not essential to use the North American Coal Sites. Nevertheless, these cookies do still fulfil important functions. You may disable any of these cookies via your browser settings or by using the links provided in the list below. However, if you do so, various functions of the North American Coal Sites may be unavailable to you or may not work the way you want them to.

The specific types of cookies served through the North American Coal Sites are described below:

Strictly Necessary Cookies: These cookies are necessary to provide you with services available through the North American Coal Sites and to use some of its features, such as access to secure areas. Without these cookies, services you have asked for, like stored passwords for log-ins, would not be possible.

Analytics Cookies: These cookies collect information that is used in aggregate form to help us understand how the North American Coal Sites are being used or how effective the North American Coal Sites are. This information will be used for the purpose of evaluating your use of the North American Coal Sites, compiling reports on the North American Coal Site activity for the North American Coal Site operators and providing the North American Coal Site operators with other services relating to the North American Coal Site activity and internet usage.

Functionality Cookies: These cookies collect information to help us customize the North American Coal Sites for you. They can be used to recognize you when you return to the North American Coal Sites. This enables the operator to personalize our content for you, greet you by name and remember your preferences (for example, your choice of language or region).

Advertising Cookies: These cookies are used to make our advertising messages more relevant to you. They perform functions like preventing the same ad from continuously reappearing, ensuring that ads are properly displayed for advertisers, and in some cases selecting advertisements that are based on your interests.

Social Media Cookies: On some pages of the North American Coal Sites, third parties that provide applications through the North American Coal Sites may set their own cookies in order to track the success of their applications or customize applications for you. For example, when you follow the North American Coal using a social media button on the North American Coal Site (e.g. LinkedIn), the social network that has created the button will record that you have done this. Because of how cookies work, we cannot access these cookies, nor can the third parties access the data in cookies used by us. Some pages of the North American Coal Sites may also contain embedded content, such as video content from YouTube, and these sites may set their own cookies.

Beacons and Widgets: Web beacons operate in a similar way to cookies and are placed on websites or in an e-mail in order to monitor the behavior of the user visiting the website or sending the e-mail.

How else do we use cookies?
